Supreme Court Unanimously Rejects Mexico's $10 Billion Lawsuit Against U.S. Gunmakers
The U.S. Supreme Court unanimously tossed out Mexico's 2021 lawsuit against seven U.S. gunmakers and one wholesaler, ruling that firms like Smith & Wesson and Glock are shielded from liability under the federal Protection of Lawful Commerce in Arms Act (PLCAA).
Mexico's lawsuit accused U.S. gunmakers of knowingly enabling illegal firearm sales to dealers linked to drug cartels, fueling cartel violence. The government sought $10 billion in damages and a court order imposing stricter rules on the marketing and distribution of firearms.
Mexico attempted to use PLCAA's narrow "predicate exception," claiming the gunmakers knowingly violated federal firearms laws by aiding and abetting illegal sales by U.S. dealers.

Supreme Court Skeptical Of Mexico's Lawsuit Against US Gun Companies

The U.S. Supreme Court seemed skeptical of Mexico's argument on March 4 that gun manufacturers should face liability for violence committed by cartels.
Multiple justices asked questions indicating that Mexico's lawsuit lacked information to allege a certain level of wrongdoing on the part of gun companies.
Justices Samuel Alito and Amy Coney Barrett asked about whether Mexico could name red flag dealers that were allegedly part of the flow of guns for illegal purposes.
“You haven't identified them that I can tell from the complaint,” Barrett told an attorney for Mexico. Justice Elena Kagan similarly told Mexico's attorney that her side didn't name particular dealers.
Justice Brett Kavanaugh asked Mexico's attorney about the economic consequences of its theory of liability. “That's a real concern for me,” he said.

This week, the US Supreme court announced that it will consider throwing out the Mexican government's suit in the case of Smith & Wesson Brands v. Estados Unidos Mexicanos. The Mexican government alleges that Smith & Wesson and wholesaler Witmer Public Safety Group Inc. are intentionally conspiring with middle-men to supply Mexican cartels with guns.
The Mexican plaintiffs have never actually proven any of this, of course, and this is all part of a larger effort by the Mexican regime and its apologists who have looked for a scapegoat to blame for Mexico's runaway homicide rates over the past twenty years.
